Pursuant to Clause 1 Article 43 of Law of the Republic of Kazakhstan №434-V dated  04.12.2015 “On  Government Procurement” (hereinafter — “the Law”), draft contracts for government procurement which refer to public contracts shall be executed in compliance with the law of the Republic of Kazakhstan and not according to standard from contracts foe government procurement.

Since power supply contracts refer to public contracts pursuant to the existing civil legislation of the Republic of Kazakhstan (Clause 2 Article 482 of the Civil Code of the Republic of Kazakhstan), a draft of a standard from contract for government procurement that you have suggested on Internet portal violates the provisions of Clause1 Article 43 of the Law. Therefore, we ask you to address “Pavlodarenergosbyt” LLP with an application for execution of a public power supply contract on power supply. After its execution in print format by contractual parties, you shall place and automatically endorse a scanned copy of the contract by your electronic digital signature and attach it on the Government Procurement Internet portal in section “non-standard contract form”. A copy of the contract, signed and sealed by an institution/enterprise in print format, shall be returned to “Pavlodarenergosbyt” LLP.

After the Applicant places the scanned copy of a public contract on the Supplier’s Internet portal, the contract will become available for signing using an electronic digital signature.

In conclusion, we wish to draw your attention to the fact that in order to place a nonstandard contract from on the Government Procurement Internet portal it is necessary to address the Technical Support of the Government Procurement portal via phone and e-mails indicated on the portal.
